FDA to Strengthen the Cosmetic Product Safety

The US Food and Drug Administration (FDA) is in a process of drafting the guidance. This step is being taken to ensure the safety of consumers. Here’s what you should know about it.

The US Food and Drugs Administration (FDA) is drafting the guidance. Under which it will assist the cosmetic companies in submitting relevant data. The companies will have to share cosmetic product facility registration, product listings, as well as the ingredients used.

ROLE OF MoCRA

Until 2022, the FDA has no authority over demanding cosmetic company details.  The ingredients used in cosmetics had no checks. The Modernization of Cosmetics Regulation Act (MoCRA) changed that in 2022. With the new Guidance, the FDA is now set to make registration and listing a requirement. This will ensure ready availability of data to the agency.

DEADLINES AND ENFORCEMENT

The draft guidelines define MoCRA requirements. The companies must submit all documents of cosmetic facility registration along with product listing on or before 29th December 2023. Along with the documents, it is mandatory to share a list of ingredients used to make the cosmetics. Additionally, it is mandatory to update facility registrations in 60 days. Renewal of facility registration will be done every two years. The draft is under construction and FDA is taking comments till 7th September 2023.

BENEFITS

  • The ingredients sharing will ensure the making of a high quality cosmetic product.
  • It will encourage the cosmetic agencies to perform better R&D.
  • Routine registrations will motivate cosmetic companies to keep the facilities at top notch condition.
  • It will facilitate easy recall of unsanitary products.
  • Product testing and inspection of facilities will become easier.
  • Harmful ingredients and products causing adverse effects can be vetted out easily.
  • The consumers will have a benefit of buying and using a good quality product.
  • The initiative is one step further in the initiative of protecting public health.

The FDA is making a conscious effort to protect public health from unregulated and harmful cosmetics. The new guidelines, once finalized, will ensure circulation of safer cosmetic and beauty products in the industry.
